Twilight Market Stallholder Terms & Conditions

Stallholders must:

1. In the case of a commercial operator, satisfy the P&C that you hold sufficient insurance (public and product liability) for all of the activities provided / goods sold or given away at your stall.

 

2. Follow all directions given by the P&C during the set-up, operation or pack up stage of the Market. You are only permitted to set up your stall / activity in the area designated to you by the P&C. You must not move or relocate your stall without first obtaining approval from the P&C.

 

3. Operate the stall / activity in a safe manner and comply with any safety plan / requirements of the P&C. Access ways must be kept free from obstruction at all times.

 

4. Be ready and set up to go at 3:30pm (Bump-in time opens at 2:30pm).

 

5. At the end of the Market, pack up and remove all stall items and dispose of all packaging materials, garbage and litter and dispose of oils, fats or wastewater responsibly. Nothing is to be left on the school grounds. Pack up must be completed and all items removed by no later than 8:30pm.

 

6. Not drive a vehicle onto school grounds without prior approval of the P&C. Vehicles may be parked in the school car park (entrance via Tristania Avenue). All goods and equipment must be carried from the school car park to your stall.

 

7. Clearly label any food items or other items that may come into contact with people (e.g. soap, creams, cleaning products), listing all ingredients. Alcohol and tobacco must not be sold / provided.

 

8. Not use a stall to promote services that the P&C considers may be illegal, immoral or inconsistent with the community nature of the market.

 

9. Hold workers compensation insurance for any employees working at the Market.

 

10. Keep all cash, floats and payments secure and not leave a stall unattended. The P&C is not responsible for any loss or theft.

 

11. Cancellation & Withdrawal

If you are no longer able to attend the event, please notify the P&C in writing as soon as possible. Cancellations made 14 days or more prior to the event will be eligible for a full refund.

Cancellations made less than 14 days prior will not be refunded, except in exceptional circumstances at the discretion of the P&C.

Failure to notify the P&C of a cancellation may affect your ability to participate in future events.

 

12. Pay for the stall and any table hire by credit card via the P&C website (www.wppspnc.com.au) or direct deposit to:

Please identify your stall / business name in the reference.

13. Working With Children Check (WWCC)

Stallholders whose activities are specifically aimed at children (e.g. face painting, children's entertainment, workshops) may be required to provide a valid Working With Children Check (WWCC) if the stallholder or their staff will be working directly with children without a parent or guardian present. The P&C reserves the right to request WWCC details where relevant and to refuse participation if appropriate documentation is not provided.

By paying for the stand/site and attending the Market the stallholder agrees to comply with all of the requirements set out above and keep the P&C indemnified from any damage to school property, and from all actions, suits, demands, losses, damages, costs, and expenses whatsoever arising from injury, death, loss, or damage to property or persons, caused or contributed to by conducting the stall and/or the products/ activities provided at the stall at any time. Understand that the indemnity shall be reduced proportionally to the extent that the act or omission of the P&C, its consultants, agents, or contractors may have contributed to the injury, death, loss, or damage.  Accept that the P&C may postpone or cancel the event at its absolute discretion and in the event that occurs agree that the P&C’s liability and obligation is limited to refunding the amount paid to the P&C and forfeit any claims that otherwise may have had for loss, damages or compensation.
